I desire to serve as a volunteer for The As I Have Loved You Foundation (the “Organization”). My volunteer activities may include assembling and delivering holiday meals (Thanksgiving, Christmas, and Easter) to low-income individuals and families.
Description of Activities and Risks
I understand that volunteer activities include, but are not limited to:
• Preparing and packaging meals or gifts at a partnering church or other facility (handling raw and cooked foods, cutting, using kitchen tools, exposure to common allergens such as nuts, dairy, wheat, etc.);
• Lifting, carrying, loading, and unloading boxes of food or gifts (up to 40 lbs);
• Driving or riding in personal or organizational vehicles to deliver meals directly to recipients’ homes or (navigating unfamiliar areas, stairs, weather conditions, animals, etc.);
• Interacting with meal recipients and entering private residences when invited.
These activities involve inherent risks of personal injury, illness, property damage, or death.
In consideration of being permitted to volunteer, I freely and voluntarily agree as follows:
Assumption of Risk
I knowingly and voluntarily assume all risks associated with my volunteer service, including but not limited to slips, falls, cuts, burns, lifting injuries, food-borne illness, allergic reactions, motor vehicle accidents, weather-related hazards (including ice and snow), and exposure to contagious diseases or illnesses.
Release of Liability
To the fullest extent permitted by Utah law, I release, waive, discharge, and covenant not to sue the Organization, its directors, officers, employees, volunteers, partnering churches, sponsors, and agents (collectively, “Released Parties”) for any liability, claims, demands, or causes of action arising out of my volunteer activities, including those arising from the ordinary negligence of the Released Parties. I understand this release does not apply to gross negligence or intentional misconduct.
Indemnification
I agree to indemnify and hold harmless the Released Parties from claims, damages, or expenses resulting from my own negligent or intentional acts while volunteering.
Medical Treatment Authorization
In the event of injury or illness, I authorize the Released Parties or emergency personnel to secure medical treatment on my behalf. I release them from liability for any treatment rendered in good faith.
No Insurance Provided
The Organization does not provide health, medical, or liability insurance for volunteers. I confirm I am responsible for my own insurance coverage.
No Workers’ Compensation Coverage
I understand and agree that I am not an employee of the Organization and am not covered by workers’ compensation benefits.
Use of Personal Vehicles
If I choose to use my own vehicle for deliveries, I certify that it is properly registered, insured, and in safe operating condition, and that I am a licensed driver.
Confidentiality
I agree to keep strictly confidential all personal information about meal recipients (names, addresses, phone numbers, family circumstances, etc.). I will not disclose or use this information for any purpose other than the authorized delivery of meals.
Compliance with Rules & Safety Standards
I agree to follow all Organization policies, food-safety guidelines, and traffic laws. I agree not to volunteer while impaired by alcohol, drugs, or medication. I acknowledge the Organization may require or conduct a background check, and my participation is contingent on satisfactory results.
Photo/Video
I grant the Organization permission, without compensation, to use photographs, video, or audio recordings of me for promotional or fundraising purposes, unless I notify the Organization in writing that I do not consent.
I will not photograph, record, or publicly post images or information about recipients or their homes.
Code of Conduct
I will treat recipients, church partners, and fellow volunteers with respect and will not engage in any behavior that could harm the Organization’s reputation or mission.
Voluntary Participation
I understand that all volunteer tasks are voluntary, and I may decline or stop participating in any activity at any time, including lifting, driving, entering homes, or any other task assigned.
Severability & Governing Law
If any portion of this Waiver is held invalid, the remainder shall continue in full force. This Waiver shall be governed by Utah law, and any lawsuit arising from my volunteer service must be filed exclusively in the state or federal courts located in Utah.
Entire Agreement
This Waiver is the entire agreement between me and the Organization regarding liability. No verbal statements or representations are binding.
I have carefully read this entire document, understand its contents, and sign it freely and voluntarily with no inducements.
IMPORTANT: THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING, YOU ARE WAIVING CERTAIN CLAIMS AGAINST THE ORGANIZATION.
